Brewster Zoning Board Approves House Rebuild Near Elbow Pond With Safety Conditions
BREWSTER — December 13, 2016 — Brewster Zoning Board approves pond-side house rebuild and stairway landing, with safety strings attached. The board voted unanimously at its December 13 meeting to approve two special permits for pre-existing nonconforming structures. The more significant case, Case 1627, involves a property owned by Warren and Madeline Zevon near Elbow Pond off Slough Road, where the family seeks to replace an existing house with a new 1,254-square-foot structure plus a 168-square-foot screened porch at 3.9 percent lot coverage — the building shifted 7.9 feet to clear a wetland setback. Attorney Duane Landreth represented the Zevons and noted Conservation Commission approval was secured November 22 after the revised plan placed the structure more than 50 feet from any wetland. The board conditioned its approval on installation of directional signage for emergency vehicles, maintenance of a 12-foot-wide access road, and receipt of final Conservation Commission and Board of Health plans — the latter including a DEP-pending Waterloo ECP phosphorus-removal septic unit the Board of Health specifically required. In Case 1629, contractor Edward Wanamaker won approval to add a landing and reconfigure stairs at 9 Captain Dunbar Road, owned by the elderly mother of applicants Barbara Beckley and Nancy Wiltz, to meet state building code safety requirements on a nonconforming lot.
