Zoning Board · Meeting of January 13, 2026

Brewster's Zoning Board of Appeals unanimously approved a special permit for a porch addition at 99 Partridge Circle that encroaches on the town's 40-foot front yard setback. Attorney Ben Zender, representing the ELIKAT Trust and trustees Daniel H. and Shari J. Crumb, told the board the lot's access road began as a 1928 easement, not a formal street, calling it "one of the purest incarnations of a pre-existing non-conforming lot" in the area.

A town planning staffer explained that Brewster's building commissioner had allowed a separate addition to proceed by right under a pre-zoning lot provision, but the porch exceeded that allowance, requiring the special permit. Five neighbors submitted letters of support and no one spoke in opposition. The board also approved its November 4, 2025, hearing minutes unanimously.
